Basis for processing - ‘Execution of agreement’ 

Hesselink Trucks B.V. is engaged in the marketing of trucks and related matters, and in particular via offers made via the Internet. This may include its own site, sales marketplaces, but also social media.  

This marketing is done on the basis of concluded purchase agreements. The provision of information by the customer, with the desire to reach an agreement - if possible - can also be included in this process.  

In order to process these agreements, it is necessary for Hesselink Trucks B.V. to process data. This takes place on the basis of ‘execution of agreement’. 

This data processed in the process may relate to orders and/or companies, but may also include data on the basis of which individuals can be identified. This may include  

• name and address details,  
• delivery addresses,  
• e-mail addresses,  
• telephone numbers,  
• bank account numbers or payment details; 

Other data related to entering into or completing an agreement, which are actively provided by the customer.  

Without this information the correct order information cannot be linked to the correct customer (account) and contact information, as a result of which it is not possible for Hesselink Trucks B.V. to fulfil the agreements correctly and/or to provide the customer with the correct information.  

 
Basis for processing - ‘Legal obligation’. 

In addition, on the basis of the fiscal administration and retention obligation, Hesselink Trucks B.V. needs to store and retain the data belonging to the basic administration (including data relating to the accounts receivable and accounts payable, as well as the purchase and sales administration) for 7 years. Only by processing the above-mentioned data does Hesselink Trucks B.V. consider itself able to meet its fiscal obligation.  

With regard to both of the above-mentioned bases Hesselink Trucks B.V. obtains this data when contact is sought by a (new) relation, whether or not via sales marketplaces, social media, contact form of, or (e-mail) correspondence with Hesselink Trucks B.V., and data are provided by this relation.  

Where necessary, this data will be processed by Hesselink Trucks B.V.. 

Processing based on ‘Consent’ basis 

Marketing communications  

With regard to marketing activities, Hesselink Trucks B.V. may deploy various parties and/or programmes for the purpose of, for example, distributing marketing communications. Data are also processed through these programmes and parties, which may involve data on the basis of which individuals can be identified.  

Without the use of these programmes it is not feasible for Hesselink Trucks B.V. to address existing and new clients.  

Before registering and processing data for these marketing activities, permission is requested from the client.  

Cookies and analysis programmes 

For marketing purposes Hesselink Trucks B.V. can make use of (the placement of) cookies and programs for the analysis of the obtained (cookie) data. This enables Hesselink Trucks B.V. to perform market research to a certain extent.  

With analysis programs it is possible to obtain information that could possibly lead to the identification of any (natural) person. For this reason, this data also falls under the scope of the AVG.

How long is (personal) data kept by Hesselink Trucks B.V.? 

Pursuant to fiscal legislation Hesselink Trucks B.V. is obliged to keep data related to bookkeeping for 7 years.  

Data obtained through the use of analysis programs are deleted at the latest 50 months after registration. Hesselink Trucks B.V. states that it considers this period to be reasonable, as it needs this period to be able to follow up on the outcome of market research and to adjust the product range and policy accordingly.

(Personal) data that does not relate to any of the above options will be removed within 6 months of receipt or adjusted in such a way that the data can no longer be traced back to a specific natural person. 

With whom does HESSELINK TRUCKS B.V. share data? 

Hesselink Trucks B.V. is obliged to make use of third parties in order to provide a good service and business operations.  

With regard to the provision of services 

Hesselink Trucks B.V. may call upon the services of third parties for e.g. the delivery of trucks, trailers and/or related items. 

These parties have (to a limited extent) access to the data of relations of Hesselink Trucks B.V.. Where necessary Hesselink Trucks B.V. enters into a processing agreement with these parties to regulate the protection and use of this data.  

Operational management 

Hesselink Trucks B.V. makes use of the services and products of third parties. For example, in addition to the use of webshop software and an external accountant, a party providing services in the field of hosting and maintenance of the website is engaged. Internally, Hesselink Trucks B.V. thereby makes use of programmes such as Microsoft Office 365.  

These parties have (limited) access to the data of relations of Hesselink Trucks B.V.. Where necessary Hesselink Trucks B.V. enters into a processing agreement with these parties to regulate the protection and use of this data.  

Marketing activities 

As previously described Hesselink Trucks B.V. deploys companies and/or cookies and/or programs for the purpose of marketing activities.  

Data already collected and/or data obtained by these parties can, after use, be deployed for the purpose of market research, improvement of website/product range and service provision, among other things. Where necessary, Hesselink Trucks B.V. enters into a processing agreement with these parties to regulate the protection and use of this data. 

Other third parties 

Without permission of the relation of Hesselink Trucks B.V., no data are further shared with other third parties. The only exception is in case Hesselink Trucks B.V. is obliged to do so on the basis of a legal provision. 

Sharing data with parties outside the EU 

For the use of programs / parties Hesselink Trucks B.V. obtains advice from third parties, such as its accountant or its internet marketing agency. If this results in the advice to have the data processed by a party outside the EU, a specific processing agreement will be entered into with that party.  

Data security 

Hesselink Trucks B.V. takes care of organisational and technical measures to secure (personal) data. These include securing the data received after use of the webshop and, where necessary, using a firewall and anti-virus software.  

Third-party websites 

This privacy statement does not apply to third party websites which are connected to Hesselink Trucks B.V. through links (or otherwise). Hesselink Trucks B.V. cannot guarantee that these parties will handle (personal) data in the desired manner. You are advised to consult the privacy statements of these third parties to find out how they handle data.  

Your rights regarding the processing and protection of personal data

Right of inspection 

You have the right to inspect the data that Hesselink Trucks B.V. holds on you.  

Right to correction, restriction and deletion  

You also have the right to have the data that Hesselink Trucks B.V. has available of you corrected, completed or deleted in its entirety.  

With regard to the removal of data, Hesselink Trucks B.V. must comply with the retention obligation imposed on it under the Act. Therefore Hesselink Trucks B.V. cannot avoid keeping the data which fall under this obligation. All other data (if any) will be removed from the systems of Hesselink Trucks B.V. upon your explicit request. 

You also have the right to restrict the processing of your personal data. This means that Hesselink Trucks B.V. will keep your data, but will no longer use them. This may apply in several cases.
